2. How to Purchase.
2.1 The contract between the Purchaser and the Seller ("La Pasta di Aldo") is concluded exclusively through the internet by accessing the Purchaser's account via a link to the site store.lapastadialdo.com .
2.2 The individual products offered can be selected and booked in the e-shop. To this end, simply select the product, the quantity and confirm, after choosing any variants. In this way the selected products will be moved to the virtual shopping cart.
2.3 Until then, all reservations made can be canceled or confirmed.
2.4 The purchase will be considered complete when the order is confirmed in the virtual shopping cart and the payment methods are selected, as described in point 4 below).
3. Shipping methods and delivery times.
3.1 All products purchased by the customer are shipped by "La Pasta di Aldo" with the use of the best national and international couriers.
3.2 Shipments are made from Monday to Friday excluding holidays according to the calendar of Italian holidays.
3.3 In order to guarantee a shipping service with tracked express courier with the best value for money, shipping is standard: within 72 working hours of the order being processed in our warehouses, the shipping service will send the Purchaser, via e-mail, a link to access the tracking of the shipment in order to obtain real-time updates on the delivery.
3.4 Although the Shipper is provided with the Buyer's telephone number for any appropriate contact, "La Pasta di Aldo" cannot guarantee that the Customer will be contacted by telephone, as the shipping service is outsourced and therefore telephone contact will only take place at the discretion of the driver who will physically take care of the delivery.
3.5 Delivery times will be based on the country of delivery; in Italy can be made within 72 hours of shipment of the order while for EU countries it will be within 96 hours.
3.6 In the event of problems for which delivery times should be extended, the Customer Service of "La Pasta di Aldo" will inform the Customer well in advance by email or sms/whatsapp message to the number indicated by the Customer.
3.7 The customer service of La Pasta di Aldo is always available to the customer to ensure safe delivery for every need.
3.8 We only ship to EU countries.
4. Shipping.
4.1 The contribution for shipping costs in Italy is €5,00 (five euros).
4.2 For shipments abroad, the contribution for shipping costs is €13,00 (thirteen euros).
TRANSITION TIMES : 48 – 96 hours from the date of shipment from our warehouse.
4.3 The Commercial Department of "La Pasta di Aldo" reserves the right to apply the "dedicated discounts" for certain periods of the year or for promotional purposes or depending on particular purchase conditions, the conditions of which will be advertised on the site or on shipping costs or on the value of the goods.
5. Methods of payment and billing.
5.1 The payment methods for those who place a direct order will be:
• credit card;
• Pay Pal.
It is understood that the delivery of the products will be subject to payment by the Purchaser of the relative price in the manner made available by "La Pasta di Aldo".
5.2 To receive an invoice it is necessary to have entered the billing data at the time of purchase, otherwise it will not be possible to issue invoices upon customer request in the post-sales phase.
5.3 Payments made by credit card or other electronic means will be made through a secure connection, supported by the Visa, Mastercard and Pay-Pal service. The Purchaser will pay for the purchases by credit card, without sharing the financial information with "La Pasta di Aldo", which therefore cannot be held responsible for any fraudulent use of the card in question. 6. Returns management and right of withdrawal.
6.1 Right of Withdrawal.
Pursuant to Legislative Decree no. 206/2005 and subsequent amendments, concerning the protection of consumers in contracts concluded at a distance, "La Pasta di Aldo" informs the Customer as follows:
a) the Customer can exercise the right of withdrawal within 10 (ten) working days from receipt of the goods ordered for any reason, without the need to provide explanations and without any penalty;
b) the right of withdrawal can only be exercised by the Customer who purchases the goods for purposes unrelated to his economic and working activity, providing his tax code and not the VAT number for invoicing;
c) the right of withdrawal must be exercised by the Customer, within the term referred to in point a), by communicating to “La Pasta di Aldo” by registered letter with return receipt addressed to “La Pasta di Aldo Srl” – Via Castelletta n. 41 – 62015 Monte San Giusto (MC) – Italy or certified e-mail to the pec box lapastadialdo@legalmail.it communication sent/sent to the address/pec strictly within the aforementioned term.
The right of withdrawal, pursuant to art. 59 Legislative Decree no. 21/2014, is excluded in the following cases:
– order of products made to measure or clearly personalized;
– order for products that are likely to deteriorate or expire rapidly;
– order of sealed products that do not lend themselves to being returned for hygienic or health protection reasons or that have been opened after delivery.
6.2 Content of the declaration of withdrawal.
The declaration of withdrawal communicated by the Customer must necessarily contain:
a) the clear and precise reference to the order for which you wish to exercise the withdrawal;
b) the express declaration of the Customer's will to withdraw entirely from the contract;
c) the description and code of the products to which the intention to withdraw refers.
6.3 Notification of the withdrawal – art. 6.1 lit. a) and c).
Notices of withdrawal sent after the expiry of the indicated term will not be considered valid.
6.4 Obligations of the Client.
The Customer undertakes to preserve and keep the products for which he intends to exercise the right of withdrawal with the diligence of the good father of the family, keeping them intact in the appropriate original packaging together with all the accessories and documentation with which they are accompanied.
6.5 Return of goods.
In order for the right of withdrawal to be validly exercised, the Consumer will be required within the same peremptory term of 10 (ten) working days from receipt of the products, to return the same to the operational headquarters of the Seller and that is to "La Pasta di Aldo Srl" - Via Castelletta n. 41 – 62015 Monte San Giusto (MC) – Italy.
It is understood that the risks and transport costs relating to the return of the products to the Seller will be borne by the Customer.
6.6 Refund.
"La Pasta di Aldo" will reimburse the Customer for the value of the products for which the right of withdrawal has been exercised, including any shipping costs, within 15 (fifteen) days of receipt of the returned goods under the terms and conditions set out above.
Refunds will be made to the same means of payment used at the time of purchase.
6.7 Damage and deterioration.
Under no circumstances may the Customer exercise the right of withdrawal if the goods are damaged and/or deteriorated.
The return of products that are not intact, damaged or missing components and/or accessories, including documentation, will not be accepted by the Seller, who will return the goods to the Customer with additional transport costs. In such circumstances, the Customer cannot exercise the right of withdrawal.
6.8 Refund guarantee or free replacement of products that do not correspond to the requests.
For all other cases that do not fall within the scope of consumer protection law, the non-consumer customer can exercise the right of withdrawal within 5 (five) days of receipt of the goods ordered solely for lack of conformity of the goods received with respect to those ordered. In this case the goods must be returned within the aforementioned term upon notification to the pec email lapastadialdo@legalmail.it contain the indication of the detected discrepancy.
No claim can be taken into consideration after 5 days. (five days) from receipt of the goods and if the material will not be returned in the original packaging.
Should these requirements fail, the goods will be returned to the sender carriage forward. However, it is understood that the guarantee on the products can only be that offered by "La Pasta di Aldo".
Pursuant to Presidential Decree no. 472 of 14/08/1996, the returned material must necessarily be accompanied by a transport document containing the number and date of the document relating to the contested product.
7. Communications and Complaints
7.1. Written communications directed to the Seller and any complaints will be considered valid only if sent to the following address: registered letter with return receipt to "La pasta di Aldo" via Castelletta 41 62015 Monte San Giusto, or sent by fax to 0733-539483 or sent by e-mail to the following address lapastadialdo@legalmail.it .
7.2 The Customer also indicates in the account registration form his residence or domicile, the telephone number or e-mail address to which he wishes communications from the Seller to be sent.
8. Storage conditions
Incoming and outgoing material from the “Pasta di Aldo” warehouse follow the FEFO (First Expired First Out) logic so as to control and guarantee the expiry date and freshness of the products. The warehouse is air-conditioned, to guarantee suitable storage conditions for the products handled. The temperature is controlled according to the terms of the law or on the indications of the manufacturers. The utmost attention is paid to the state of conservation of the products both during storage and during shipment.
9. Packing features.
The products will be packed and shipped with the utmost care and safety, respecting the environment and hygiene. In this way the goods will travel safe and well protected.
10. Control of the goods.
The Customer or, on his behalf, the person in charge of collecting the goods will be required to check, at the time of delivery and in the presence of the carrier, the integrity of the packages delivered and their number, reporting in writing any discrepancies in the number and/or lack of integrity of the packages in the appropriate reserved space in the transport document (DDT), which, duly signed, will remain with the carrier. Once this is done, the Customer must contact "La Pasta di Aldo" to report any problems within 5 days of delivery.
11. Responsibility.
11.1 As regards any damage caused by defects in the “La Pasta di Aldo” Products, the provisions of the European Directive 85/374/EEC and the Consumer Code will apply.
11.2 "La Pasta di Aldo" assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even when dependent on malfunctions and disservices of the internet, inherent to the shipment and/or delivery, in the event that it fails to execute the order within the times established by the contract.
12. Applicable law and competent court.
12.1 The sale between the Customer and the Seller is understood to be concluded in Italy and these General Conditions are governed by Italian law, with the express exclusion of the 1980 Vienna Convention on Contracts for the International Sale of Goods (Convention on Contracts for the International Sale of Goods - "CISG").
12.2 It remains understood that the rules established by the Consumer Code and/or by other consumer protection regulations do not apply in the event that the Customer has the status of professional pursuant to art. 3, 1st paragraph, lett. c), of the Consumer Code.
12.3 For the solution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders, in the event that the Customer has the status of Consumer pursuant to art. 3, 1st paragraph, lett. a), of the Consumer Code, the Court of your Municipality of residence or domicile has exclusive jurisdiction. In all other cases, the territorial jurisdiction is exclusively that of the Court of Macerata, any other competent court excluded.
13. Acceptance of the contract conditions.
13.1 By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the General Contract Conditions.
13.2 Pursuant to and for the purposes of articles 1341 and 1342 of the Civil Code, the Customer, after having taken careful and specific knowledge and vision, expressly approves and accepts the following clauses:

5. Methods of payment and billing;
6. Management of returns and right of withdrawal;
9. Inspection of the goods;
11. Liability;
12. Applicable law and jurisdiction.
